General Terms and Conditions of Sale

INTRODUCTION

This document sets out the general terms and conditions governing the use of this website (fortunnaazores.pt) and the purchase of products (hereinafter referred to as the “Conditions”). By using this website and/or placing an order, the User accepts these Conditions without reservation.

We recommend that you carefully read our Conditions and Privacy and Cookie Policy before using this website. If you do not agree with them in their entirety, you should not place an order. These Conditions may be amended at any time, and it is the User’s responsibility to review them periodically.

OUR DETAILS

The sale of goods through this website is carried out by Meatrading, Lda., a private limited liability company with its registered office at Rua da Venda, Lote 6, 4705-629 Sequeira, Braga (Portugal), registered with the Commercial Registry Office of Vila Nova de Famalicão. The company operates under the trade name “FORTUNNA”.

YOUR PERSONAL DATA AND YOUR VISITS TO THIS WEBSITE

The information and personal data provided by the User will be processed in accordance with the Privacy and Cookie Policy. By using this website, the User declares that all information provided is true and accurate.

USE OF OUR WEBSITE

By using this website, the User undertakes to place only legally valid orders and not to place any false or fraudulent orders. The User confirms that they are over eighteen (18) years of age and have the legal capacity to enter into contracts.

FORMATION OF THE CONTRACT

To place an order, you must follow the online purchasing process and click on “Authorise Payment”. You will receive an “Order Confirmation” email, followed by a “Dispatch Confirmation” email. The Contract will remain available on the website for download or printing.

PRODUCT SPECIFICATIONS AND WEIGHING (PERISHABLE GOODS)

Given the nature of the products sold by FORTUNNA, the following specific conditions apply:

Fresh Products and Cuts: Fresh meat products are prepared and cut to order according to the User’s requirements.
Weight Variations: As the cutting process is carried out manually using traditional methods, the User acknowledges and accepts that the final weight of the product may vary slightly from the weight stated on the website.
Price Adjustment: The final invoiced price will always correspond to the price displayed on the website, regardless of the actual weight.

TECHNICAL METHODS FOR CORRECTING ERRORS

If the User identifies an error in their personal details, they may correct it in the “My Account” section or contact technical support at online@fortunnasa.com.

PRODUCT AVAILABILITY AND SUBSTITUTION

All orders are subject to stock availability.

Non-Perishable Goods:

If accessories or condiments are unavailable, FORTUNNA will inform the User of alternative products or issue a refund.

Perishable Goods:

Due to the freshness requirements, if a specific cut is unavailable at the time of preparation, FORTUNNA will contact the User to propose an alternative of equivalent quality or arrange a partial cancellation of the order.

REFUSAL TO PROCESS AN ORDER

FORTUNNA reserves the right to remove products or modify website content at any time and may refuse to process orders in exceptional circumstances, even after an Order Confirmation has been sent.

DELIVERY AND DELIVERY TIMES

FORTUNNA undertakes to dispatch orders within an estimated maximum period of 48 working hours for mainland Portugal.

Delivery Schedule:

Deliveries are not made on Saturdays, Sundays or public holidays.

Receipt of Goods:

Delivery shall be deemed to have taken place when the delivery receipt is signed at the specified address.

Shipping:

Shipping is available to mainland Portugal only.

INABILITY TO DISPATCH AND FOOD SAFETY

Non-Perishable Goods:

If delivery cannot be completed, the order will be returned to the warehouse and a notification will be left to arrange a new delivery date.

Perishable Goods:

Given their highly perishable nature and the need to maintain the cold chain, the User acknowledges that FORTUNNA cannot guarantee the integrity of fresh products if delivery fails due to the recipient’s absence.

User’s Responsibility:

If delivery of perishable goods fails due to circumstances attributable to the User (e.g. an incorrect address or absence), FORTUNNA reserves the right not to refund the value of any products that become unfit for consumption as a result of the delay caused.

TRANSFER OF RISK AND OWNERSHIP

The risk associated with the products passes to the User upon delivery. Ownership of the products is transferred once all amounts due have been paid in full.

PRICE AND PAYMENT

Prices include VAT at the applicable statutory rate.

Payment Methods: We accept bank transfers.

Shipping and Delivery Costs

– The prices displayed on the website do not include delivery costs, which will be added to the total amount payable at checkout.

– For deliveries to mainland Portugal, FORTUNNA charges a flat shipping rate of €9.50 (nine euros and fifty cents), including VAT, regardless of the weight or volume of the goods, except where duly indicated promotional offers apply.

– Free Shipping: FORTUNNA offers free shipping on orders with a net product value of €100 (one hundred euros) or more, for deliveries to mainland Portugal.

– The User will be expressly informed of the total shipping costs before confirming their payment authorisation.

– For orders containing Perishable Goods, the shipping cost includes the specialised packaging required to maintain the cold chain during the 48-hour transit period, ensuring the food safety of the products until delivery.

GUEST CHECKOUT

The User has the option to make purchases without registering an account.

RETURNS POLICY AND RIGHT OF WITHDRAWAL

Right of Withdrawal (Non-Perishable Goods)

The User has the right to withdraw from the contract within 14 days without giving any reason. Products must be returned in their original packaging and show no signs of use.

Exclusion of the Right of Withdrawal (Perishable Goods)

Under Portuguese law, the right of withdrawal or return does not apply to:

– Goods which are liable to deteriorate or expire rapidly by their nature (Fresh Meat).

– Sealed goods which are not suitable for return due to health protection or hygiene reasons if unsealed after delivery.

Returns of Defective Products

In the event of a lack of conformity, the User must contact FORTUNNA immediately by email, providing photographs of the product. If the defect is confirmed, a full refund or replacement will be provided.

LIABILITY AND WAIVER

FORTUNNA’s liability is limited to the purchase price of the product. We do not guarantee that the website will operate without interruptions or technical errors.

INTELLECTUAL PROPERTY

All content on this website is owned by Meatrading, Lda. or by third parties who have authorised its use.

VIRUSES AND IT SECURITY

The intentional introduction of viruses or malicious software is prohibited. Any breach of this provision will be reported to the relevant authorities.

LINKS TO THIRD-PARTY WEBSITES

We are not responsible for the content of external websites linked to for informational purposes.

WRITTEN COMMUNICATION

The User agrees that communications will primarily be conducted by electronic means.

NOTIFICATIONS

Notifications should preferably be sent to online@fortunnasa.com.

ASSIGNMENT OF RIGHTS AND OBLIGATIONS

The Contract is binding on both parties. The User may not assign their contractual position without prior written consent.

FORCE MAJEURE EVENTS

FORTUNNA shall not be liable for delays caused by strikes, natural disasters or government decisions beyond its reasonable control.

WAIVER

Failure to enforce an obligation at any given time shall not constitute a waiver of any future rights.

SEVERABILITY

If any clause is declared null and void, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

These Conditions constitute the entire agreement between FORTUNNA and the User.

AMENDMENTS TO THE CONDITIONS

We reserve the right to amend these Conditions at any time.

GOVERNING LAW AND JURISDICTION

The use of this website is governed by Portuguese law. Any disputes shall be submitted to the Portuguese courts.

COMPLAINTS AND DISPUTE RESOLUTION

We value your feedback. Complaints may be sent to online@fortunnasa.com.

– Alternative Dispute Resolution: The User may refer disputes to CIAB – Consumer Information, Mediation and Arbitration Centre (Braga).

– Complaints Book: Available via the official link on the website.
